Traditionally, divorcing spouses could choose between physical custody and legal custody. However, under current Louisiana law, these responsibilities are now outlined in a parenting plan, which includes:

 

  • The child's living arrangements

  • The amount of time the child spends with each parent

  • How information and records regarding the child are shared with each parent

In cases where the divorce is amicable or uncontested, parents can negotiate a parenting plan together or resolve any minor disagreements through mediation. However, if the court is required to make a decision, it often favors assigning the majority of parental responsibilities to the primary caregiver, typically the mother. In such situations, the non-primary parent may also be required to pay child support.

Common Disputes and Options for Modifying Parental Responsibility Arrangements

The noncustodial parent (the parent with whom the child does not primarily reside) is typically granted parenting time, also known as visitation. However, conflicts can arise even after the divorce if one parent attempts to interfere with the other parent's parenting time or alienate them from the child. Disputes can also occur if one parent needs or desires to relocate out of state or far from the child’s current home. In some cases, a third party, such as a grandparent, may be granted parental responsibilities if neither parent is deemed fit.
