What Is Lawful Permanent Residency?

A Lawful Permanent Resident (LPR) is someone who has been granted the right to live and work in the United States indefinitely. Green Card holders can travel in and out of the country, petition certain family members to immigrate, and—after a period of time—apply for U.S. citizenship.

However, permanent residency does not mean unconditional residency. Green Card holders must comply with immigration laws, renew their card every 10 years, and avoid certain criminal or immigration violations that can jeopardize their status.

Paths to Permanent Residency

There are several ways to qualify for lawful permanent residence. The most common categories include:

1. Family-Based Immigration

You may be eligible if you are:

  • The spouse, child, or parent of a U.S. citizen

  • The spouse or unmarried child of a lawful permanent resident

  • A fiancé(e) of a U.S. citizen entering under a K-1 visa

  • The widow(er) of a U.S. citizen

Note: Immediate relatives of U.S. citizens (spouse, unmarried children under 21, and parents) are not subject to visa caps and typically have shorter waiting periods.

3. Refugee or Asylee Status

Individuals granted asylum or refugee status can apply for a Green Card one year after being admitted or approved for such status.

2. Employment-Based Immigration

You may qualify through your job or professional skills if:

  • You have a permanent job offer from a U.S. employer

  • You qualify for extraordinary ability or national interest waiver (EB-2)

  • You are a skilled worker, professional, or investor (EB-3 / EB-5)

  • You are a religious worker or special immigrant

4. Diversity Visa Lottery

Each year, the U.S. government issues a limited number of immigrant visas to individuals from countries with historically low immigration rates to the United States.

The U.S. Citizenship and Immigration Services (USCIS) requires government filing fees, which vary by case type. Typical expenses include:

  • Petition for Family-Based Immigration: $675

  • Adjustment of Status (green card within the U.S.): $1,440

  • Employment Authorization (optional): $260

  • Advance Parole (optional): $630

  • Consular Processing Fees (if applying abroad): $120–$325 p/p

  • Permanent Resident Card (Green Card): $235
